The Lok Sabha reopened debate on the Bharatiya Sakshya (Second) Bill, 2023, the Bharatiya Nyaya (Second) Sanhita, 2023, and the Bharatiya Nagarik Suraksha (Second) Sanhita, 2023. The Indian Penal Code (IPC), 1860 is the primary law governing criminal offences in India. The Bharatiya Nyaya (Second) Sanhita, 2023 aims to replace it. The new bill includes community service as an additional penalty. In 2023, the Criminal Procedure Code (CrPC) is to be replaced by the Bharatiya Nagarik Suraksha (Second) Sanhita.
The arrest, prosecution, and bail processes are outlined in the CrPC. The Indian Evidence Act of 1872 is replaced by the Bharatiya Sakshya (Second) Bill, 2023 (BSB2). The Act controls whether or not evidence is admissible in Indian courts. It is applicable to all criminal and civil cases. These laws include a provision for digitising the entire process, from the filing of the FIR to the case diary, the charge sheet to the judgement, and so on.
